Warranty

PRODUCT WARRANTY (14 July 2017)

The following warranties apply to all products described in the First Schedule (“Products”) and the accessories provided with those Products by Judea Holdings Limited trading as Paul Industries (“Paul Industries”) where those Products and accessories are installed in accordance with the Installation Requirements set out below.

Each warranty runs from the date of purchase for the warranty period specified in the First Schedule for that Product:

Each Product and the associated accessories:

a. Will be free of defects due to faulty or defective factory workmanship;

b. Will be free of defective materials;

c. Where the Product has a BRANZ appraisal, will comply with the relevant provisions of the building code to the extent set out in the relevant BRANZ product appraisal.

Each warranty is also subject to the Warranty Conditions below.

INSTALLATION REQUIREMENTS

Each Product and all accessories must be installed in accordance with the following requirements for the warranty provided on the Products and accessories to be valid.

1. The Product is installed by or under the direct supervision of a registered or licensed building practitioner and maintained strictly in accordance with any Paul Industries instructions, methods and procedures relating to the Products and current at the time of installation.
2. The Product must be installed using Paul Industries supplied or recommended components or products as specified in  the instructions or specifications relating to the Product.
3. The Product must be installed in accordance with the New Zealand Metal Roof and Wall Cladding Code of Practice. Furthermore, all other Products, including coating and joining systems, applied to, or used in conjunction with the Product must be applied or installed by a registered or licensed building practitioner and maintained strictly in accordance with the relevant manufacturer's instructions and good trade practice.

WARRANTY CONDITIONS

1. This warranty is not transferrable.
2. Paul Industries will not be liable under any warranty provided in relation to a Product or accessory unless:

a. the customer provides proof of purchase and written details of the claim detailing the issues with the Products or accessories;

b. written notification required by clause 2a above is provided within 5 days after the defect was discovered and prior to installation;

c   where the defect was discovered after installation, the customer must provide (in addition to the details required by clause 1 above) specific details of the installation including the name and qualifications of the installer and the date the Product was installed.

3. Any project in which the Product is used must be designed and constructed in strict compliance with all relevant provisions of the current New Zealand Building Code ('the Building Code'), regulations and standards and in accordance with the terms specified in any building consent issued by the local or territorial authority with jurisdiction over the area in which the project is being undertaken.
4. In the event that a warranty claim is made in relation to a Product and that claim is accepted by Paul Industries, the total liability of Paul Industries to the customer is limited to either, at Paul Industries’ option:

a. The supply of product at no cost to the customers, that is the same as or functionally equivalent to the original Product;

b.  the repair, at no cost to the customer, of the Product; or

c.  refunding the customer for purchase price of the affected Product.

5. Paul Industries will not be liable for any claim, loss or damage (whether direct or indirect) including property damage or personal injury, consequential loss, economic loss or loss of profits, howsoever arising. Without limiting the foregoing, Paul Industries will not be liable for any claims, damages or defects arising from or in any way attributable to settlement or structural movement and/or movement of or failure of materials to which the Product is attached, incorrect design of the structure, acts of God including but not limited to earthquakes, cyclones, floods or other severe weather conditions or unusual climatic conditions, normal wear and tear, growth of mould, mildew, fungi, bacteria or any organism on any Product.
6. All warranties, conditions, liabilities and obligations other than those specified in this warranty are excluded to the fullest extent allowed by law. In particular, where the Product is supplied for the purposes of a business, the guarantees contained in the Consumer Guarantees Act 1993 do not apply.
